TERMS & CONDITIONS

Love Yosemite Inc.

RENTER REQUIREMENTS

For legal and accounting purposes, the person placing the reservation must be the same as the credit or debit card holder. This person is considered the Guest. All other persons associated with the rental are considered the Guest's invitees. All matters regarding reservation, cancellation, and damage policies will be addressed with the Guest directly, not with the Guest's invitees.


CANCELLATION POLICY

Refund eligibility is based on the number of days prior to the scheduled check-in date at the time of cancellation.

–  Cancellations made 30 days or more prior to check in will receive a full refund less the processing fee of 5.85%

–  Cancel 7–29 days before check-in: 50% refund of the total rental amount, less the processing fee of 5.85%.

–  Cancel within 7 days or less before check-in: No refund will be processed.

Additionally, if a booking is made at least 72 hours before the check-in date, guests may cancel within 24 hours of booking for a full refund.

Please note: This cancellation policy is much more flexible that industry standards and will be enforced for all circumstances, including those beyond the Guest's or Management's control, including but not limited to: wildfire, smoke, air quality, adverse weather, guest health issues, family emergencies, road conditions, power outages, foreign wars, cancelled flights, early checkouts, guest forgetting to cancel, and no-shows. Our region experiences all four seasons and the natural events that come with each. We strongly encourage all guests to review seasonal conditions before booking.

Travel insurance is STRONGLY recommended and is typically available during the booking process, and can be purchased separately through a variety of travel insurance providers. Please note that Love Yosemite Inc. is not affiliated with any travel insurance company and has no authority over their claims or payout decisions.




RESERVATION MODIFICATION

Any modification to reservation dates — including shortening the length of stay or changing arrival/departure dates — must be submitted to Love Yosemite Inc. at least 30 days prior to the scheduled arrival date. Date modifications will not be permitted once the arrival date is fewer than 30 days away.

Guests may add nights to an existing reservation at any time, subject to availability and successful payment for the additional night(s).


PAYMENT SCHEDULE

The following payment schedule is firm and cannot be altered:

–  Bookings made more than 30 days before arrival: 50% deposit due at booking. Remaining 50% automatically charged 30 days prior to arrival.

–  Bookings made within 30 days of arrival: Full payment due at booking.

Once final payment is processed, the card on file cannot be changed.

If final payment is declined, Guest will be notified via email and/or phone and have 48 hours from the initial decline to provide a valid form of payment. If payment is not collected within that window:

Reservation will be cancelled, and a full refund less a 5.85% processing fee will be refunded back to the card on file. 


RENTAL AGREEMENT

Shortly after booking, Guest will receive this Rental Agreement via text and email. The Rental Agreement must be signed within 48 hours of booking to finalize the reservation. This requirement exists to protect both the Guest and Management against fraud and to ensure all parties are in agreement with the terms of the stay. It also allows Guest to go straight to the property on day of check in, without going to a physical office to sign. 

If the Rental Agreement is not signed within 48 hours, Management will make one attempt to contact the Guest via text and/or email. If the agreement remains unsigned 24 hours after the contact attempt, Management reserves the right to cancel the reservation under the following terms:

–  If the arrival date is more than 30 days away: the reservation will be cancelled and a full refund less a 5.85% processing fee will be issued. 

–  If the arrival date is 30 days or fewer away: the reservation will be cancelled and a full refund less a 5.85% processing fee will be issued. 

Guest understands that failure to sign the rental agreement at any point will result in no access being granted to the property.


LAST-MINUTE BOOKINGS

For any reservation made within 72 hours of the scheduled arrival date, the following terms apply:

–  Full payment is due at the time of booking. In the event payment is declined or unsuccessful, the reservation will be immediately cancelled with no grace period and no fees will be charged.


DAMAGE WAIVER & DAMAGES

All properties are professionally inspected before and after each reservation. By agreeing to these Terms, the Guest authorizes Love Yosemite Inc. to charge the card on file for any damages not covered by the damage waiver, including but not limited to: missing items, excessive cleaning fees, fines, and — if necessary — costs incurred to remove the Guest from the property.

Guest reservation automatically comes with a built-in damage waiver, and is NOT an additional charge, as it is already included in the rate. This waiver covers accidental damages to the property up to $1,000. To be eligible for waiver coverage, all damages must be disclosed in writing prior to checkout.

Love Yosemite Inc. maintains a zero-tolerance policy regarding excessive noise, parties, and disturbances to neighboring properties. These terms are strictly enforced.


PROPERTY

Guest rents, for short-term vacation purposes only, the furnished real property and improvements described in the rental agreement.


ARRIVAL & DEPARTURE

–  Check-in: No earlier than 4:00 PM on the arrival date. Delays may occur due to unforeseen circumstances.

–  Check-out: No later than 11:00 AM on the departure date.

Early check-in and late checkout are available only with prior written approval from management.

Unauthorized Early Check-In: Guests who access the property prior to the scheduled check-in time will be charged $100.00 per hour. Charges are calculated by rounding down to the nearest full hour prior to the scheduled check-in time. For example, if check-in is at 4:00 PM and a Guest accesses the property at 2:45 PM, the charge will be calculated from 2:00 PM — resulting in a $200.00 fee.

Unauthorized Late Check-Out: Guests who have not vacated the property by the scheduled check-out time will be charged $100.00 per hour. Charges are calculated by rounding up to the nearest full hour after the scheduled check-out time. For example, if check-out is at 11:00 AM and a Guest vacates at 11:45 AM, the charge will be calculated to 12:00 PM — resulting in a $100.00 fee.

Excessive Late Check-Out: If a Guest has not vacated the property more than 2 hours after the scheduled check-out time, Love Yosemite Inc. reserves the right to bill the Guest for an additional full night's stay. In the event an incoming guest is affected by the delay, the Guest will also be held responsible for any relocation costs incurred to accommodate the incoming guest at an alternative property.


UNAVAILABILITY

If, for any reason beyond Management's control, the property becomes unavailable, Management may substitute a comparable unit or cancel this Agreement and issue a full refund of all payments made by the Guest.


NOISE ORDINANCE

A strict noise ordinance is in effect. No loud noises, amplified music, or loud vehicles are permitted between 10:00 PM and 8:00 AM. Violations may result in contact from the local Sheriff's Department, fines, and/or mandatory vacation of the premises. No refunds will be issued in these instances.


APPROVED GUESTS & USE

The property is reserved for use as a personal vacation residence by approved guests only. The reserving Guest is responsible for all persons who access the property during the rental period. Guest occupancy must not exceed the maximum occupancy of the property at any time.

In the event the maximum occupancy is exceeded, Management reserves the right to:

–  Immediately cancel the reservation and remove all persons from the property, with no refund issued; or

–  Allow the reservation to continue and charge the card on file a $300.00 fee per unauthorized occupant.

The course of action will be at the sole discretion of Management. Regardless of the outcome, exceeding maximum occupancy constitutes a breach of this Agreement and may result in forfeiture of all rental funds collected.

No unlawful activity or activity constituting a nuisance is permitted on the premises.


PETS

Love Yosemite Inc. welcomes pets at many of our properties. The following policies apply to all guests traveling with pets:

–  All pets must be disclosed at the time of booking, or prior to check-in, so that an updated Rental Agreement can be signed.

–  Love Yosemite Inc. does not charge a separate pet fee for up to two pets per reservation.

–  A maximum of two pets are permitted per reservation. Any additional pets brought to the property will result in a $300 fee per extra pet charged to the card on file.

–  Pets are not permitted at non-pet-friendly properties. Violations will result in a $300 fee per pet and/or immediate cancellation of the reservation with no refund.

–  Pets — including service animals — may never be left unattended inside or outside the property at any time.

–  All local county laws regarding leashing your pet while outside the home must be adhered to at all times.

–  Service animals are welcome at all properties regardless of pet policy.

–  Any damage caused by pets is the sole responsibility of the Guest and is not covered by the damage waiver. The Guest will be charged for all pet-related damages to the card on file.


CLEANING

The property will be delivered to the Guest in professionally cleaned condition. If the Guest's use requires cleaning beyond the standard scope, the Guest will be charged for the associated excess costs.


CONDITION OF PREMISES

Upon arrival, the Guest shall inspect the premises, including all furniture, furnishings, appliances, fixtures, and landscaping, and promptly report in writing any items that are not in proper operating condition or appear to be in disrepair. Reporting a repair need does not entitle the Guest to cancel this Agreement or receive a refund.


PEST CONTROL

All Love Yosemite Inc. properties are located in the Sierra Nevada Mountains, where homes share the environment with a variety of wildlife and insects, including mice. Licensed pest control companies are contracted by each homeowner to help minimize any potential intrusion. While encounters are unlikely, guests may come across these inhabitants during their stay. Please notify Management of any intrusion so that reasonable mitigation steps can be taken.


LOST OR LEFT ITEMS

Management assumes no responsibility for lost, stolen, or abandoned items. Reasonable efforts will be made to contact the Guest for item retrieval. A $35.00 handling fee plus actual shipping costs will be charged for any items returned at the Guest's request. Management is not liable for the condition of returned items. Any items not claimed within 30 days may be donated or otherwise disposed of.


MAIL & SHIPPING

Shipping or mailing items to the property is not permitted, as many homes are accessed via lockbox. Please do not ship any packages to the property address. If you need to receive mail or a package in the area, please contact Love Yosemite Inc. — we can typically arrange for delivery to our office in Oakhurst, CA.


NO PARTIES OR LARGE GATHERINGS

All Love Yosemite Inc. properties are located in residential communities and may not be used for weddings, receptions, parties, or large gatherings of any kind. Disruptive events may result in immediate eviction and forfeiture of the entire rental amount and security deposit.



ILLEGAL SUBSTANCES

No illegal substances are permitted on the property. Minors are not permitted to possess or consume alcohol. Violations will result in immediate eviction, and no refunds will be issued.


TV, CABLE, INTERNET & SATELLITE

These services are provided as a convenience only and are not guaranteed as part of this Agreement. No refund will be issued for service outages, content availability, internet speed, access difficulties, unfamiliarity with service use, or personal preferences.


SYSTEM FAILURES

In the event the property sustains a failure of any system — including but not limited to: water, sewer, septic, electrical, gas, plumbing, mechanical, appliances, heating, ventilation, pool, or hot tub — neither the property owner nor Management shall be liable to the Guest for damages, and no refunds will be issued for such failures. Management will make reasonable efforts to promptly repair or replace the affected system, and the Guest agrees to provide Management or its service providers with reasonable access to the property to complete such repairs.


UNFORESEEN OCCURRENCES

Management assumes no liability for loss, damage, or inconvenience caused by circumstances beyond its control, including but not limited to: weather conditions, natural disasters, pests, construction, or acts of God. No refunds will be issued for such occurrences. Travel and rental insurance is strongly recommended.


RULES & REGULATIONS — NO COMMERCIAL USE

Guest agrees to comply with all rules and regulations posted on the premises or provided to the Guest. Guest, and all of the Guest's invitees and licensees, shall not:

–  Disturb, annoy, endanger, or interfere with neighboring properties or other guests;

–  Use the premises for any commercial or unlawful purpose, including the use, manufacture, sale, storage, or transport of illegal substances or contraband;

–  Violate any applicable law or local ordinance; or

–  Commit waste or create a nuisance on or about the premises.


DEFRAUDING AN INNKEEPER

Pursuant to California Penal Code § 537, it is a criminal offense to obtain lodging with the intent to defraud. This includes, but is not limited to: leaving the property without paying all amounts owed, providing fraudulent payment information, using a stolen or unauthorized credit card, obtaining a reservation through false pretenses, or occupying the property with more guests than declared at the time of booking without authorization and payment.

Guests who bring undisclosed occupants and refuse to pay applicable fees upon request may be subject to immediate removal from the property and reported to the Madera County or Mariposa County Sheriff's Department, as applicable to the property's jurisdiction. Love Yosemite Inc. will cooperate fully with law enforcement in any such investigation and will pursue all available legal remedies.


AMENITIES

Swimming & Hot Tub Amenities

Swimming pools, lakes, hot tubs, creeks, and rivers present unique safety hazards. There are no lifeguards on duty; swimming is at the Guest's own risk. Health risks associated with hot tubs and whirlpool baths are the Guest's responsibility to understand and communicate to their group.

Hot tubs are for relaxation only. Standard bathing products (soap, shampoo, conditioner, oils, etc.) are not permitted. Hot tub covers must remain on when the tub is not in use; covers must not be sat upon, stood on, or misused. Guests may be charged for damage to these amenities. Introduction of any foreign object into a hot tub or pool may result in a charge of up to $500.00 to cover draining, refilling, and chemical rebalancing.


MAINTENANCE & REPORTING

The Guest shall properly use, operate, and safeguard the premises — including all landscaping, furniture, furnishings, appliances, and mechanical, electrical, gas, and plumbing fixtures — and keep them clean and sanitary. The Guest shall immediately notify Management of any problem, malfunction, or damage discovered during the stay. Guest is responsible for the cost of all repairs or replacements caused by the Guest that are not covered by — or exceed the coverage of — the damage waiver, excluding ordinary wear and tear. Failure to timely report damage may result in additional charges to the Guest.


ENTRY BY MANAGEMENT

Management and its authorized representatives reserve the right to enter the premises at any time:

–  To make necessary or agreed-upon repairs, improvements, or to provide services;

–  To verify Guest compliance with the terms of this Agreement; or

–  In the case of an emergency.

With at least 24 hours' advance notice, Management may also enter the premises to show the property to prospective purchasers, tenants, lenders, appraisers, or contractors.


TERMINATION OF OCCUPANCY

Upon departure, the Guest shall:

–  Follow the simple checkout procedures.

–  Vacate the property and surrender it to Management at the agreed-upon checkout time;

–  Clear all parking and storage areas; and

–  Return the property to Management in the same condition as received.


PERSONAL PROPERTY & INJURY

Owner Insurance: Guest's personal property — including vehicles — is not insured by the Owner or applicable HOA against loss or damage caused by fire, theft, vandalism, water, criminal acts, or any other cause. Owner and Management do not insure against personal injury to the Guest or the Guest's invitees unless caused by the condition of the premises.

Guest Insurance: Management strongly recommends that the Guest obtain insurance to protect themselves, their invitees, and their personal property against potential loss or damage.

Indemnification: The Guest agrees to indemnify, defend, and hold harmless the Owner and Management from all claims, disputes, litigation, judgments, costs, and attorney fees arising from loss, damage, or injury to the Guest or the Guest's invitees or their personal property.


MEDIATION

Guest agrees to participate in good-faith mediation of any dispute or claim arising from this Agreement before pursuing arbitration or legal action. Mediation fees, if any, shall be divided equally among the parties.


JOINT & INDIVIDUAL OBLIGATIONS

If more than one person is identified as a Guest, each individual is fully and independently responsible for the performance of all obligations under this Agreement, jointly and severally with all other Guests.


RELEASE OF LIABILITY

In consideration of the right to occupy the property, Guest agrees to release, to the fullest extent permitted by law, the Owner and its Management, members, officers, associates, employees, agents, representatives, attorneys, assigns, and affiliates from all liability or responsibility of any kind for any personal injury, death, property damage, or other loss sustained by the Guest, the Guest's minor children, or any person allowed on the property during the rental period — including losses resulting from the negligence of Owner or Management. This release is binding upon the Guest's heirs, administrators, executors, and any other person or entity seeking to claim through the Guest.


ENTIRE AGREEMENT

This Agreement constitutes the entire contract between the Owner and Guest and supersedes all prior agreements, understandings, and representations. It is intended as the final and complete expression of the parties' agreement and may not be contradicted by prior or contemporaneous oral statements. If any provision of this Agreement is found to be invalid or unenforceable, all remaining provisions shall remain in full force and effect. Waiver of any breach shall not be construed as a continuing waiver of the same or any future breach.

By proceeding with a reservation, the Guest acknowledges that they have read, understood, and agree in full to all terms and conditions set forth in this Agreement. Acceptance of this Agreement is a condition of the reservation and constitutes a binding contract between the Guest and Love Yosemite Inc.
